Organizations Filed Purposes:
The mission of the Disability Rights Education and Defense Fund is to advance the civil and human rights of people with disabilities through legal advocacy, training, education, and public policy and legislative development.
DREDF works to replace the legacy of disability discrimination with the core principles of equality of opportunity, disability accommodation, accessibility, and inclusion through education and training, legal advocacy, and public policy development.
Legal Advocacy - DREDF represents people with disabilities and organizations serving people with disabilities on impact cases that further civil rights for people with disabilities. DREDF serves as co-counsel and files amicus briefs in the appellate courts and the US Supreme Court. In one representative appellate case, DREDF joined the Judge David L. Bazelon Center for Mental Health Law and the Dentons law firm to file an amicus brief in Texas v. U..S., a matter on appeal in the 5th circuit, on behalf of 13 disability rights organizations. The case was originally brought in district court by a number of states, led by Texas, that claimed the Affordable Care Act (ACA) was rendered unconstitutional when the Trump administration reduced the mandatory penalty for failing to buy health insurance to zero, because the ACA was based on Congress' authority to tax and there was no longer a tax.As an IOLTA Support Center, DREDF provided significant legal training, legal technical assistance, and advocacy support to California IOLTA legal services programs on disability civil rights. DREDF attorneys and other staff conducted trainings at the 2019 Pathways to Justice Conference, which brings together hundreds of legal aid and public interest attorneys. We led trainings on obtaining records from public agencies using FOIA and CPRA requests, accessibility for disabled people in direct legal services, accessibility in communications and documents, and the intersection of disability and race in justice in education.
National Disability Policy and Research - DREDF conducts research, monitors public policy development and provides technical assistance on issues affecting the civil and human rights of people with disabilities and advocates for the rights of people with disabilities. In 2019, DREDF submitted comments to the US Department of Health and Human Services stating that work requirements harm disabled people in response to its proposal to allow States to impose such work requirements in Medicaid as a condition of eligibility. We advocated for the continuation of the Money Follows the Person (MFP), a federal program that provides funds to help disabled people and older adults move from institutions to homes of their own and receive home and community-based services to live independently.
Children and Family Advocacy - DREDF provides training and technical assistance on the rights of children with disabilities in special education to parents, advocates and professionals. One of our Children and Advocacy projects, the Community Parent Resource Center aids significantly underserved and isolated youth with disabilities, and families whose children with disabilities:Have been or are at risk of being incarcerated;Have been or are at risk of being secluded and/or restrained at school;Have experienced repeated disciplinary actions including multiple suspensions or have been expelled;Have been or are in out-of-home placements (e.g., foster care, homeless families);Have been harassed, bullied, or abused because of their disability, or because of the intersection of disability, poverty, involvement in child welfare, and sexuality.
