Organizations Filed Purposes:
MCLS PROMOTES THE SAFE, HUMANE, AND LAWFUL TREATMENT OF MASSACHUSETTS PRISONERS THROUGH CIVIL RIGHTS LITIGATION, ADMINISTRATIVE ADVOCACY, CLIENT COUNSELING, AND OUTREACH TO POLICY MAKERS AND THE PUBLIC.
PLS HANDLES APPROXIMATELY 1,400 BRIEF SERVICES MATTERS ANNUALLY AND WE HAVE APPROXIMATELY 25 CASES ON OUR DOCKET (INCLUDING 5 MEDICAL PAROLE RELATED CASES). OUR LITIGATION IS SYSTEMIC IN NATURE. WE ARE ALSO ADVOCATING FOR MULTIPLE BILLS THAT WOULD IMPROVE CONDITIONS FOR OUR CLIENTS AND THEIR FAMILY MEMBERS. CASES: PLS SETTLED A CASE AGAINST THE DEPARTMENT OF CORRECTION REGARDING THE PLACEMENT OF PRISONERS IN ADMINISTRATIVE SOLITARY CONFINEMENT IN WHICH THEY ARE AFFORDED SIGNIFICANTLY MORE DUE PROCESS PROTECTIONS. WE FILED A WRONGFUL DEATH ACTION AGAINST HAMPDEN COUNTY AND THE SPRINGFIELD POLICE DEPARTMENT ON BEHALF OF A WOMAN (AND HER ESTATE) WHOSE SERIOUS HEALTH NEEDS WERE IGNORED BECAUSE SHE WAS DISCRIMINATED AGAINST BASED ON HER SUBSTANCE USE DISORDER, AND WE SETTLED CASES ON BEHALF OF CIVILLY COMMITTED INDIVIDUALS WHO, DESPITE THEIR COGNITIVE IMPAIRMENTS, WERE PLACED IN EXCESSIVE RESTRAINTS AND PERIODS OF ISOLATION AT BRIDGEWATER STATE HOSPITAL. THE CASE LED TO EXTENSIVE REFORMS AND A MORE THERAPEUTIC PROGRAM FOR THOSE IN CUSTODY. PLS ALSO PARTIALLY SETTLED A LARGE CLASS ACTION CASE ON BEHALF OF DEAF AND HARD OF HEARING PRISONERS, WHO WILL FINALLY HAVE ACCESS TO HEARING AIDS AND ASL INTERPRETERS FOR ESSENTIAL PROGRAMMING. PLS, AS PART OF THE CRIMINAL JUSTICE REFORM ACT OF 2018, WAS APPOINTED TO TWO LEGISLATIVE COMMISSIONS: ONE ON THE USE OF SOLITARY CONFINEMENT AND THE OTHER ON THE HEALTH AND SAFETY OF LGBTQI PRISONERS. OUR INVOLVEMENT IN BOTH OF THESE COMMISSIONS HAS LED TO ADDITIONAL REFORMS AND COMMITMENTS TO FURTHER IMPROVEMENTS ACROSS THE CORRECTIONAL SYSTEM. DUE TO OUR STRONG COMMUNITY AND LEGISLATIVE RELATIONSHIPS, WE WERE ALSO SUCCESSFUL IN TESTIFYING AGAINST RESTRICTIVE PROPOSED REGULATION IN BOTH OF THESE AREAS IN ADDITION TO MEDICAL PAROLE (A COMPASSIONATE RELEASE PROGRAM PLS WORKED TO PASS IN 2018). LEGISLATORS WORKED ALONGSIDE US TO MAKE CLEAR THAT THE REFORMS PASSED AS PART OF THE CRIMINAL JUSTICE REFORM ACT WERE NOT REFLECTED IN THE DEPARTMENT'S AND THE EXECUTIVE OFFICE OF PUBLIC SAFETY'S PROPOSED REGULATIONS.
