The mission of the ACLU Foundation of Texas Inc. (ACLU Foundation) is to advance freedom, dignity and equality for all people, particularly those who have been historically left out of the promise of America due to systemic oppression, disenfranchisement and discrimination.
The mission of the ACLU Foundation of Texas Inc. is to be the state's foremost champion of individual civil rights and the broad array of other issues affecting individual freedoms in the United States through public education.
Immigrant Rights - The ACLU of Texas played a critical role in protecting immigrants and border communities. Our work with migrants released from Custom and Border Patrol custody led the Office of Inspector General to investigate and to issue a scathing report documenting inhumane detention conditions in CBP facilities in the Rio Grande Valley. The report was widely reported in the media and used in litigation. We worked with ACLU National to challenge the Trump administrations so-called Remain in Mexico policy, which turns away people seeking asylum in the U.S. by sending them to Mexico to await their immigration court date. We obtained the release of pregnant women living in dangerous encampments because of the program. We filed litigation to stop construction of the Border Wall and to assure asylum seekers access to counsel.
Smart Criminal Justice - Our criminal justice work prioritized reducing mass incarceration in Texas, which disproportionately affects people of color and the poor. With our pro bono legal partners we litigated several cases challenging the practice of jailing people solely because they are too poor to pay fines or post bail, while wealthier accused are released because they can pay fines. Our efforts resulted in a first-in-the-nation federal court rulings that Texans are entitled to be represented by counsel at bail hearings and that municipal court judges are prohibited from jailing people for unpaid fines unless they have access to counsel when they enter a plea. When COVID began circulating in Texas prisons and jails in early 2020, we spearheaded an effort to educate nearly 500 key criminal justice stakeholders in Texas about the risks and mitigation strategies.
Reproductive Freedom - We filed a federal lawsuit against seven Texas municipalities for passing anti-abortion ordinances that discriminate against and stifle pro-abortion speech and association and brand pro-abortion organizations as criminal, banishing them from the cities. We filed the suit on behalf of two organizations, Texas Equal Access Fund and Lilith Fund, which assist people in obtaining abortions and advocate to ensure access to abortion in Texas.
