Organizations Filed Purposes: DISABILITY RIGHTS WASHINGTON'S MISSION IS TO ADVANCE THE DIGNITY, EQUALITY, AND SELF DETERMINATION OF PEOPLE WITH DISABILITIES. WE WORK TO PURSUE JUSTICE ON MATTERS RELATED TO HUMAN AND LEGAL RIGHTS.

PROTECTION AND ADVOCACY FOR INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES PROGRAM (PADD): PREVIOUSLY, DRW HAD FILED A LAWSUIT ABOUT GIVING PEOPLE WITH DEVELOPMENTAL DISABILITIES WHO WISH TO LIVE IN THE COMMUNITY THE SUPPORTS NEEDED TO BE SUCCESSFUL LIVING OUT OF INSTITUTIONS. THIS FISCAL YEAR, DRW CONTINUED TO LITIGATE AND ULTIMATELY, NEGOTIATED A SETTLEMENT. AS A RESULT, THE STATE REQUESTED THE LEGISLATURE INCREASE RESIDENTIAL PROVIDER RATES OVER THE NEXT SEVERAL YEARS BY INVESTING AN ADDITIONAL $150M FOR PRIVATELY OPERATED COMMUNITY-BASED RESIDENTIAL SERVICES, AND AN ADDITIONAL $32M TO EXPAND THE STATE-RUN COMMUNITY RESIDENTIAL SERVICES TO SERVE INDIVIDUALS CURRENTLY IN INSTITUTIONS.

PROTECTION AND ADVOCACY FOR INDIVIDUALS WITH MENTAL ILLNESS PROGRAM (PAIMI): NUMBERS SERVED: DRW WON A LAWSUIT IN A PREVIOUS FISCAL YEAR ABOUT THE STATE'S UNCONSTITUTIONAL WAREHOUSING OF PEOPLE WITH MENTAL ILLNESS IN JAILS. THE STATE HAS REPEATEDLY FAILED TO COMPLY WITH THE COURT ORDERS ISSUED IN THIS CASE AND BY THE BEGINNING OF THIS FISCAL YEAR, THE STATE HAD RACKED UP NEARLY $90M IN CONTEMPT FINES AND WAS NOWHERE NEARER TO COMPLYING WITH THE COURT ORDER THAN IT WAS YEARS BEFORE WHEN THE ORDER HAD BEEN HANDED DOWN. THIS YEAR, THE COURT APPROVED A SETTLEMENT DRW NEGOTIATED WITH THE STATE. THE SETTLEMENT AGGRESSIVELY OVERHAULS COMMUNITY AND INPATIENT SERVICES, BY MAKING SWEEPING CHANGES THAT WILL LEAD TO DECRIMINALIZING MENTAL ILLNESS THROUGH CHANGES IN CRIMINAL LAW PRACTICES, LAW ENFORCEMENT ENGAGEMENTS, AND SIGNIFICANT INCREASES TO COMMUNITY BASED SERVICES INSTEAD OF INCARCERATION AS WELL AS FASTER ACCESS TO INPATIENT MENTAL HEALTH SERVICES IN OUR STATE HOSPITALS FOR THOSE WHO STILL NEED TO BE INVOLVED IN THE CRIMINAL LEGAL SYSTEM. THE FEDERAL COURT FOUND THE WORK OF DRW AND OUR CO-COUNSEL REMARKABLE AND SAID SHE HAD NEVER SEEN A CASE MOVE FROM THIS LEVEL OF CONTEMPT TO A MUTUALLY AGREEABLE PATH FORWARD THAT IF IMPLEMENTED WILL ELIMINATE THE CONSTITUTIONAL HARM SUFFERED BY CLASS MEMBERS. THE LEGISLATURE SIMILARLY RESPONDED POSITIVELY THIS YEAR TO THE PROCESS AND OUTCOME OF THIS CONTEMPT SETTLEMENT BY MAKING ALL OF THE NUMEROUS CHANGES TO LAWS AND PROVIDING OVER $70M IN NEW FUNDS FOR ADDITIONAL SERVICES FOR THIS BUDGET THAT WILL START THE REFORMS. ALL OF THIS IS JUST A DOWN PAYMENT FOR FUTURE ADDITIONAL SERVICES THAT WILL BE ADDED AS THE SUBSEQUENT PHASES OF THE AGREEMENT ROLL OUT OVER THE NEXT SEVERAL YEARS.

PROTECTION AND ADVOCACY OF INDIVIDUAL RIGHTS PROGRAM (PAIR) - DRW COMBINED ITS FEDERAL PROTECTION AND ADVOCACY MANDATES AND AN INTERSECTIONAL PERSPECTIVE OF INJUSTICE TO ADDRESS INADEQUATE CARE FOR TRANSGENDER PRISONERS WITH DISABILITIES. THROUGH CONTINUED WORK WITH THE TRANS PRISONER COALITION, DRW INVESTIGATED THE CONDITIONS AND TREATMENT OF PRISON INMATES WITH DISABILITIES WHO ARE TRANSGENDER. DRW FOUND THEY FACE MANY BARRIERS THAT IMPACT ACCESS TO MEDICAL AND MENTAL HEALTH CARE, AS WELL AS APPROPRIATE HOUSING PLACEMENTS WITHIN PRISON. THIS INVESTIGATION AND SUBSEQUENT INDIVIDUAL ADVOCACY WORK FOR TRANS PRISONERS RESULTED IN DRW ENGAGING IN SYSTEMIC ADVOCACY WITH THE DEPARTMENT OF CORRECTIONS (DOC). AS A RESULT, DOC ENDED ITS CONTRACT WITH A PROBLEMATIC MEDICAL PROVIDER WHO WAS PROVIDING HEALTH CARE SERVICES AND TRAINING THAT DID NOT FOLLOW ACCEPTED MEDICAL STANDARDS OF CARE, REMODELED SHOWER STALLS IN A MINIMUM OF SIX PRISON UNITS TO ALLOW FOR TRANSGENDER WOMEN LIVING IN MEN'S FACILITIES TO SHOWER WITHOUT THEIR BREASTS EXPOSED TO STAFF AND PEERS, CHANGED TWODOC POLICIES AND INITIATED CHANGES TO SEVEN MORE POLICY CHANGES AT THE END OF THE FISCAL YEAR. DRW HAS PREPARED LITIGATION TO ADDRESS ADDITIONAL CONCERNS AROUND TRANS PRISONERS' ACCESS TO MENTAL AND PHYSICAL HEALTH CARE, BUT AS OF THE CLOSE OF THE FISCAL YEAR, DOC HAS BEEN OPEN TO DISCUSSIONS OF ADDITIONAL REFORMS TO RESOLVE THESE ISSUES WITHOUT LITIGATION.
